Vigo County Expungement
Indiana Code 35-38-9 provides a process for sealing certain arrest and conviction records. In Vigo County, you file an expungement petition in the court that handled the original case. Arrests that did not result in charges are eligible right away. Dismissed cases qualify after one year. Misdemeanor convictions need five years, and Level 6 felonies need eight.
The judge considers the offense type, elapsed time, and whether you have any new criminal charges. If the petition is granted, the records are sealed from public view. They will not show up in MyCase or ISP searches for the general public. Law enforcement agencies still have access.
