Spencer County is a small jurisdiction, so the jail holds fewer inmates than larger counties. Still, the booking process works the same. When someone is arrested, deputies take them to the county jail for processing. Staff record the charges, take a photo, and set the initial bond. If a bond schedule applies, the person may post bail right away. For more serious charges, a judge sets the bond at an initial hearing.

Note: Spencer County does not run its own online jail roster. You need to use the state portal or call the jail to check on current inmates.

Spencer County Court Records

Criminal cases that come from Spencer County arrests are filed in the Spencer Circuit Court in Rockport. The court clerk handles all case filings and keeps records of charges, hearings, and outcomes. You can look up these records for free on MyCase, which is the state court records portal. Type in a name or case number to find what you need. MyCase does not need an account and costs nothing to use.

Court records show more detail than jail booking logs. They track each step of a case from the initial charge through sentencing or dismissal. If someone was arrested in Spencer County and the prosecutor filed charges, the case will appear in MyCase within a few days of filing. The system shows hearing dates, case status, and the judge assigned to each matter.

Note: Not every arrest leads to a court case. If the prosecutor decides not to file charges, there may be a booking record with no matching court case in the system.

Spencer County Expungement

Indiana Code 35-38-9 allows certain arrest and conviction records in Spencer County to be sealed through expungement. If you were arrested but never charged, you may be able to get the record sealed. Dismissed cases also qualify in many situations. Some misdemeanor and felony convictions can be expunged after a waiting period that depends on the type of offense.

To start the process, you file a petition in the Spencer Circuit Court where the case was handled. The judge reviews the petition and considers the offense type, how much time has passed, and whether you have any new charges. Once granted, the sealed records will not show up in public searches on MyCase or through the ISP criminal history check. Law enforcement can still access sealed records, but the general public cannot.

  • Arrests with no charges filed: eligible right away
  • Dismissed cases: eligible one year after dismissal
  • Misdemeanor convictions: waiting period of five years
  • Level 6 felony convictions: waiting period of eight years
  • More serious felonies: longer waiting periods or not eligible

Talk to a local attorney if you are not sure whether your case qualifies. The Spencer County court clerk can also tell you what forms are needed to file the petition.
